Disability Law:
Whether you need short-term disability due to a surprise illness or injury, or you've obtained a long-term disability that will limit your ability to work for the foreseeable future, Stock Law can help you through the tiresome and stressful legalities. Disability law is difficult to handle without the help of a legal team. Your disability is already a struggle on its own, then on top of that is the complex and frustrating insurance system. Often times, you'll start with short-term disability, then find that it's going to be long-term, only for the insurance company to decide that you no longer qualify for disability so they don't have to pay you.
Reach out to us before starting the disability claim process to ensure you're getting the money you deserve and that it's protected for as long as you need it. We've worked with clients in Reading and the surrounding areas to help them get their money. Reach out now to start the process to get yours.
Social Security Disability Benefits:
The process of getting your SSD benefits after an illness or injury can be an uphill battle with a high chance of a denial. The technical requirements for SSD benefits includes 1) a significant work history and 2) a diagnosis that will make working impossible for at least 12 months. However, you'll usually need much more evidence like doctor's testimonies and other witnesses. Stock Law's lawyers are experienced in gathering this evidence and arguing in defense of our client's and their disability. This process is long and complicated and difficult to prevent people from abusing it, but it often means it denies qualifying people. Make the process easier on yourself and have a better chance at receiving your benefits with Stock Law.

Civil Litigation
Civil litigation, what is it? It's a non-criminal legal dispute between two parties. It often involves one party seeking compensation or relief from another. Something that makes civil litigation different from criminal proceedings is the burden of proof being much lighter. Our civil litigators are skilled at gathering and convincingly presenting evidence during cases, so we are better at helping our clients get the outcome they desire. We have strong negotiation skills and know when to push for a trial or request a settlement.
What is involved in the civil litigation process? The first step is determining how winnable your case is. This decides how the next steps go. If it's winnable we will file for a lawsuit, but if it's not we would work on what alternatives you have. After filing the lawsuit, we gather evidence, get depositions of witnesses and others, and ensure we have enough to move forward with settlement or a trial. Once the trial has a verdict, we continue to help by appealing an unwanted verdict or helping you handle an appeal from the other party.
Some particular civil litigation cases we've worked on include: contract disputes, healthcare, risk management, lemon law, neighbor disputes, pet law, and small claims court.

Municipality Law
Your local municipality may need legal aid with merging fire departments, contract drafting, zoning, and other matters boards, agencies, and local government authorities handle. Mismanaging a contract or bid for construction can delay or ruin a project, and making sure everything is handled legally and effectively can be difficult without the proper experience and know-how. We have represented several municipalities and fire departments in the Berks, Montgomery, and Chester areas on issues such as public housing, labor laws, merging, subdivision and land development, employment, board governance, condemnation, land use, and. civil rights actions.
We also offer legal services in:
Code enforcement
Local governments set a code that usually dictates land matters in the area. Things like how much space must be between houses, the condition of the property, how many additions are permitted on a home, and requirements for fences and sheds are dictated by codes. When a code is violated, the municipality may need to issue warnings or a citation (similar to a parking ticket). Whether you are the municipality handling a resident who's gotten permission from elsewhere to violate the code, or you're the resident who has reason to fight the code violation, Stock Law has experience on both sides of the situation.
Easements
What is easement? It's when a property owner gives a party or individual permission to enter or use the owner's property. Some examples include a utility company getting permission to run pipes or wires through a homeowner's property, a historical society preventing a property owner from using the property for certain uses, or one neighbor allowing another to use their driveway to access the other's home.
An easement is held up like a deed would, so it's important to have the proper legal help to navigate making, changing, or dissolving one. Easements can even be verbal, which can lead to more conflict if the parties involved disagree. It's important to talk to a lawyer about easements with your property so you understand and control how things happen on your land and how this may effect your property value.
Election law
Running for an elected position on a local or state level is a difficult and rule-filled process to ensure you can demonstrate you can serve in that position. The laws in place for running for an office are complex and different for different roles, so you need someone on your team to help you navigate the legal system. You may even be taken to court by a citizen or fellow candidate for a violation, but Stock Law can help you. And if you're a citizen, we can help you take a candidate to court for violations of the election law.
HOA representation
Homeowner Associations have many positives and negatives depending on what you want out of your living arrangements. For some, HOAs are limiting and prevent owners from making their home their own. For others, HOAs come with a sense of community and belonging that most people want in life. It's important that you understand and house or condo HOAs before moving in and how it would limit and help your life there. Stock Law has represented both the HOAs and individual homeowners before, so we understand all aspects of the legal requirements.
About HOAs
Vocabulary
Declarations: Rules/laws established by the developer.
Bylaws: Rules added or changed by the HOA, usually by a vote after many meetings.
Meeting minutes: Each HOA meeting has a member taking notes on what was discussed or decided. Usually, they are kept and you can request to see them if you missed a meeting.
Budget & financial statements: The HOA needs to keep record of their budget and if they grew the budget it’s a sign the HOA is being managed well.
CC&Rs: Rules relating to the appearance of various aspects of the homes and property under an HOA.
Membership:
The reason research is so important is that buying a condo or home in an HOA automatically makes you a member and means you will pay membership dues. These dues go to things like a repair fund, pool maintenance, fitness centers, and other amenities.
Assessments:
The fees and dues of an HOA membership can change with time depending on what amenities and resources are in the HOA and in the surrounding areas.
Involvement:
It’s important to be an active member of your HOA so you have a say in what happens in your community. If you want certain amenities or a different lawn care service, you need to know when to go to a meeting and when to voice your needs. The HOA is similar to local governments in that way, that the people must share their thoughts and the officials must consider that when deciding how the HOA is run. Don’t move to an HOA if you don’t plan to be an active member.
